Since we are trying to bring people to our side, and offenders (rebels) to return to the Constitution, I would think that any opportunity to offer that the bad guys could redeem themselves should be taken.
Instead of the Geneva Convention, I would suggest (as I did in the Plan http://www.outpost-of-freedom.com/blog/?p=365, outlined in the full version) that we revise the Lieber Code, established in the 19th century, to apply to our circumstances (http://outpost-of-freedom.com/library/Lieber%20Code%20for%20the%20P...). We are not nations at war, rather restoring the Constitution. Unlike Vietnam and other recent wars, hearts and minds can make a difference with people of the same nation.

If they are foreign troops on our soil, unconditional surrender is the only option. I don't, however, as everybody else anticpates, expect that to happen, if we use the Plan as a guideline to restore the Constitutional government.
However, there is always the possibility that trioops may come in across our southern border. They should either surrender, unconditionally, which might require a very short meeting under a flag of truce, no negotiations, or, be chased back across the border.
Though I didn't agree with what we did on the road the Basrah, I would condone such a plan in the circumstance described -- highway of death.
