I will be at the trial!! I hope other's will come as well! We need to show all the support we can!! This man is being railroaded with no proof!! All they have is a cohersed claim!! I will be leaving Texas Satuday for Duncan!

As double jeopardy applies only to charges that were the subject of an earlier FINAL judgment, there are many situations in which it does not apply despite the appearance of a retrial. For example, a second trial held after a mistrial does not violate the double jeopardy clause because a mistrial ends a trial prematurely without a judgment of guilty or not. Failure to acquit and failure to convict are two sides of the same coin.

Forrest,we have tried to get lawyers to go pro-bono,but all either wont do it or want to be paid what he cannot pay.

Apparently everyone thinks he is guilty until proven innocent.

I personally believe that sticking with the lawyer that got through to at least one juror that J4P is not guilty is the smart thing to do. I think he's probably helped in ways we'll never see including with the bail process. If everyone assumed guilt, the bail bondsmen and agents would. It's simply not true, and J4P IS walking around able to keep his nose clean while his defense grows and the prosecuter's case crumbles. In fact, I won't be surprised if the prosecuter drops charges when he sees the man isn't going to fold.

Chancy,, trust me,, they are not going to drop these charge's!! They know if they do,,, J4P is going to sue them for all they are worth and i do not blame him!! The lawyer has nothing to do with anything good in this case,, his lawyer is a joke!! Just last week the judge told him that if he fire's his lawyer,, that J4P goes to jail!! Didn't know that a judge could do that!! Your right about the double jeopardy,, it was a hung jury!! Yes they retry on a hung jury 3 time's!! I can tell you exacly what happened during the deliberation,, i was there!! J4Ps lawyer is catering to the procecution not him!! His Lawyer botched the change of venue for Charles and refuses to object to anything that will help J4P in his case!! This is not a court appionted attorny either folk's,, this family shelled out over $60.000 on this man!! This is the most obvious set up i have ever seen in a court room anywhere in my whole entire life!! This whole thing just has not been fair at all! I am not speaking from info i got from other sorces either,, i have been up to Duncan to stand with Charles many time's!! I personally know this whole family well! It is a shame to watch this come down on such fine people!! I am directly involved!!

Minuteman, I have no reason to not trust you. I respect your opinions and your involvement is and has been honorable.  I know there are often political reasons for what prosecuters do and don't do. And I personally think most lawyers are a joke! But I also beliieve in the old saying that a citizen who serves as their own legal counsel has a fool for a client. There ARE indeed reasons that bail can be revoked, not just at the judge's discretion, But also a mandate driven by state law. Foe instance, the condition of bail has changed and the bail lbondsman/agent requests protection from further risk. At the point of revokation of one bail, that does not mean that the accused is not entitled to affordable bail. We all are. but Bail may need to be re-established and negotiated. I do doubt the integrity
 of the judge in this case if he didn't fully explain that to J4P instead of just making a blatant threat to revoke. If the later can be proven, the Judge should be made to recuse himself.

 

My prayers are with Charles, his family, you and everyone who takes American justice seriously, and won't turn their backs on a fellow vet unless there is absolutely no doubt.

Your right Clancy,, i will not give up any Patriot until there is absolutely no doubt!! We better all get that way real quick to or we are going to see this activity picking up steam!! I will just be happy that it isnt like that here where i live, a person still gett's a fair trial here! We have a damn good Sheriff and deputie's here in Edwards County!! Judge to from what i understand( he is a new one i haven't met yet) I hear he is a good judge from what folk's say!! Just love that backwood's life!! GOD BLESS TEXAS!! : ) It is still America here! Well,,,,, in most of the little town's,, one has to bear in mind that the state of Texas has more rural town's per capita than all of the state of Texas major cities combined,,, man that is a lot of pissed off country boy's and girl's!! Down here we dont care nothin about our color's Brown, white,black, yellow or red!! We all have that common bond called being an AMERICAN!! God bless Rocksprings Texas,, she aint perfect but i wouldn't live anywhere else,, i hope that never change's!!
